Terms of Use

1. Acceptance of the Terms

By accessing or using the MidiaKits platform, available at www.midiakits.com, you agree to these Terms of Use and to our Privacy Policy. If you do not agree with any provision, do not use the service.

2. Description of the Service

MidiaKits is a digital platform that allows content creators to build professional media kits and share them with brands and partners. The platform offers social network connection features for automatic display of audience metrics (Instagram, YouTube and TikTok), along with media kit customization and sharing tools.

3. Registration and Account

To use MidiaKits, you must create an account providing truthful and up-to-date information. You are responsible for keeping your access credentials confidential and for all activity performed on your account. Notify MidiaKits immediately of any unauthorized use of your account at thiago@kairala.com.br.

4. Social Network Integration via OAuth

MidiaKits lets you connect your Instagram (Meta), YouTube (Google) and TikTok accounts through OAuth authentication. By connecting your accounts, you authorize MidiaKits to:

  • Read public metrics of your account (followers, reach, engagement, views);
  • Display those metrics on your media kit;
  • Store access tokens securely and encrypted.

MidiaKits does not publish content on your behalf, does not access private messages and does not use your credentials for any purpose other than those described above. You may revoke access at any time in your account settings or directly on the Meta, Google and TikTok platforms.

5. Intellectual Property

All content of the MidiaKits platform — including brand, logo, design, texts and code — is the exclusive property of MidiaKits. The content you create and publish on your media kit remains your property. By using the service, you grant MidiaKits a non-exclusive license to display your content on the platform as needed to provide the service.

6. User Conduct

It is prohibited to use MidiaKits to:

  • Violate applicable Brazilian or international laws;
  • Publish false or misleading content, or content that infringes third-party rights;
  • Engage in spam, phishing or any form of platform abuse;
  • Attempt to access other users' systems or data without authorization;
  • Use metrics information for fraudulent purposes.

Failure to comply with these rules may result in suspension or termination of your account without prior notice.

7. Limitation of Liability

MidiaKits is provided "as is", without express or implied warranties. MidiaKits is not liable for service interruptions, data loss or damages resulting from the use of the platform, except as provided by Brazilian law. The availability of metrics through the Meta, Google and TikTok integrations depends on those platforms and may be affected by changes to their APIs.

8. Changes to the Terms

MidiaKits may update these Terms at any time. Relevant changes will be communicated by e-mail at least 15 (fifteen) days in advance. Continued use of the platform after the new terms take effect implies your acceptance.

9. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil, in particular the Lei Geral de Proteção de Dados (LGPD — Brazilian Law 13,709/2018) and the Marco Civil da Internet (Brazilian Law 12,965/2014). The courts of the district of the service owner's domicile are elected to settle any disputes.
